Terms and Conditions
The following are the terms and conditions of use of the tjdecor.co.uk website and call centre. Please read these terms and conditions carefully before you use the tjdecor.co.uk website or call centre. By using the tjdecor.co.uk website or call centre you indicate that you accept these terms and conditions. If you do not accept these terms and conditions you must not use the tjdecor.co.uk website or call centre.
PARTIES
This Agreement is made between you the customer ("Customer") and TJ Painting & Decorating having its office at Unit 3, The Green Barn, Venthams Farm, Froxfield Green, Petersfield GU32 1DJH; tjdecor.co.uk is a trading style of TJ Painting & Decorating, providing painting and decorating services to domestic customers in the UK;
In this Agreement, unless the context otherwise requires: "Law" means any law, statute or regulation, guideline or code of conduct (whether or not having the force of law) in any jurisdiction to which tjdecor.co.uk or the Customer is from time to time subject; "Service" means the service provided by tjdecor.co.uk via the tjdecor.co.uk website, in person at the custoemr premises or over the telephone whereby the Customer may obtain a quatation for decorating services and, potentially transact with the TJ Painting & Decorating for the provision of those services and/or products;
tjdecor.co.uk reserves the right to amend these terms and conditions at any time. All amendments to these terms will be posted on-line. The Customer may terminate the Agreement by written notice to tjdecor.co.uk if the Customer does not wish to be bound by such new terms and conditions. Continued use of the Service or the tjdecor.co.uk website will be deemed to constitute acceptance of the new terms and conditions.
PROVISION OF THE SERVICE
The Customer will complete and submit an online Contact Us form thereby providing their contact details to TJ Painting & Decorating.
A member of staff from TJ Painting & Decorating will contact the Customer by email or phone to confirm the details provided in the Customer’s completed form and gain consent to proceed with providing the customer with a free no-obligation quotation for decorating services. PAYMENT
Use of the tjdecor.co.uk service is currently free. The Customer will be clearly notified of any applicable charges before any such services can be selected or before any charges are levied.
The Customer shall be responsible for transmitting all payments due to Suppliers on the terms agreed with the relevant Supplier and tjdecor.co.uk shall have no responsibility for transmission of payments to a Supplier.
Certain Suppliers will require payment details from the Customer buttjdecor.co.uk will not request payment details from the customer at any time.
INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights (including all copyright, patents, trademarks, service marks, trade names, designs (including the "look and feel" and other visual or non-literal elements) whether registered or unregistered) in the tjdecor.co.uk website, information and content on the tjdecor.co.ukwebsite, any database operated by tjdecor.co.uk and Software shall remain the property of tjdecor.co.uk and the Customer shall not obtain, and shall not attempt to obtain any title to any such intellectual property rights.
No part of the Service may be reproduced in any form or used in any other way except in accordance with these terms and conditions.
tjdecor.co.uk and the tjdecor.co.uk logo are registered trademarks of TJ Painting & Decorating. You must not use these or any other registered or unregistered trade marks on the Service without the prior written permission of TJ Painting & Decorating.
tjdecor.co.uk grants the Customer a non-exclusive non-transferable licence to use the Software solely in executable form and only to the extent necessary for use of the Service and for no other purpose.
CUSTOMER BREACH
The Customer shall compensate tjdecor.co.uk in full for each loss, liability or cost incurred by tjdecor.co.uk arising out of: 1. any claims or legal proceedings arising from the Customer's use of the Services which are brought or threatened against tjdecor.co.uk by any other person; or
any breach of this Agreement by the Customer.
LIMITATION OF LIABILITY
Nothing in these terms and conditions limits or excludes the liability of tjdecor.co.uk for death or personal injury caused by heatergrants.co.uk 's negligence or any other liability which may not be limited or excluded under applicable law.
tjdecor.co.uk will use its reasonable endeavours to ensure that information provided to Customers by Suppliers is accurate but tjdecor.co.uk does not guarantee the accuracy, completeness, legality or suitability for the Customer's needs of any information which is provided to the Customer by any Supplier and/or is accessed or obtained by the Customer via the tjdecor.co.uk website, the tjdecor.co.uk call centre or otherwise through using the Service.
Subject to clause 8.1, you agree that tjdecor.co.uk will not be liable for any loss, claim or damage (whether direct or indirect) which arises out of or is in any way connected with: (i) any use of the Service, the tjdecor.co.uk website or its contents; (ii) any failure or delay in any component of the tjdecor.co.uk website, the provision of the Service or the provision by any Supplier of its goods, products or services to the Customer (including, without limitation, where the Customer has a delayed or failed installation with a Supplier and/or the Customer is unable to obtain the energy efficiency grant which he or she may have otherwise been entitled to were it not for the failure or delay); (iii) any use of or reliance upon any information, material, software, products or services obtained through the tjdecor.co.uk website, the tjdecor.co.uk call centre or otherwise through using the Service (including, without limitation, any information, material, software, products or services of any Suppliers); or (iv) any transaction or agreement between the Customer and any Supplier or any attempt to enter into a transaction or an agreement with any Supplier, in all cases even if tjdecor.co.uk has been forewarned of the possibility of such loss or damage.
DATA PROTECTION
tjdecor.co.uk shall comply with all applicable data protection laws in the UK. For a description of how tjdecor.co.uk uses personal data the Customer should refer to tjdecor.co.uk 's Privacy Policy.
NO PARTNERSHIP / AGENCY
Nothing in this Agreement shall be construed to create a joint venture, partnership or agency relationship between the Customer and tjdecor.co.uk and neither party shall have the right or authority to incur any liability debt or cost or enter into any contracts or other arrangements in the name of or on behalf of the other.
ASSIGNMENT
The Customer shall not assign or delegate or otherwise deal with all or any of its rights or obligations under this Agreement. tjdecor.co.uk shall have the right to assign or otherwise delegate all or any of its rights or obligations under this Agreement to any person or entity
FORCE MAJEURE
tjdecor.co.uk shall not be liable for any breach of its obligations under this Agreement where it is hindered or prevented from carrying out its obligations by any cause outside its reasonable control, including without limitation by lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, act of God, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any law, accident (or by any damage caused by any of such events).
ENTIRE AGREEMENT AND NO WAIVER
This Agreement represents the entire understanding between the parties in relation to the subject matter herein and supersedes all other agreements or representations by either party, whether oral or written. 2. No waiver by tjdecor.co.uk of any future defaults, whether of a like or different character. No granting of time or other forbearance or indulgence by tjdecor.co.uk to the Customer shall in any way release, discharge or otherwise affect the liability of the Customer under this Agreement.
NOTICES

GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of England and Wales and both parties hereby submit to the non-exclusive jurisdiction of the courts of England and Wales.
TERMS AND CONDITIONS - ACCEPTANCE OF QUOTATION & PAYMENT
Progress payments may be requested throughout the course of the work Please take special note of job description. TJ Painting and Decorating
Services is not required to perform any projects or tasks not specifically listed.
INSURANCES
Public Liability insurance of £5m currently with Trade Direct 01483 521 650 Please feel free to contact our insurance company for a copy of a
Certificate of Insurance.
GUARANTEE
Notes Continued...TJ Painting and Decorating Services guarantee Labour and Material for a period of two (2) years. If paint failure appears, we will supply labour and materials to correct the condition without cost. This warranty is in lieu of all other warranties, expressed or implied. Our responsibility is limited to correcting the condition as indicated above. This warranty excludes, and in no event will TJ Painting and Decorating
Services be responsible for consequential or incidental damages caused by accident or abuse, temperature changes, settlement or moisture; i.e., cracks caused by expansion and/or contraction. Cracks will be properly prepared as indicated at time of job, but will not be covered under this warranty. Horizontal walking surfaces are excluded from this warranty.
WORK STANDARDS
TJ Painting and Decorating Services is a member of the Dulux Select Decorators.
All work is to be completed in a workman like manner according to standard practices. Worker/s will remain on job until completion of project
The work site will be cleaned daily and upon project completion.
All agreements are contingent upon strikes, accidents, or delays beyond our control. The painting contractor will produce a "properly painted surface". A "properly painted surface" is one that is uniform in colour and sheen. It is one that is free of foreign material, lumps, skins, sags, holidays, misses, strike-through, or insufficient coverage. It is a surface that is free of drips, spatters, spills, or over-spray which the contractors' workforce causes.
Compliance to meeting the criteria of a "properly painted surface" shall be determined when viewed without magnification at a distance of five feet or more under normal lighting conditions and from a normal viewing position.
CUSTOMER RESPONSIBILITY
Please take specific note of job description. Colours must be chosen one (1) week prior to start date.
Built In Wardrobes / Cupboards are not included in price unless otherwise stated.
Please have fragile, valuable or breakable items and electronics moved out of work areas prior to start of project.
Alarms must be turned off while work is in progress.
Wallpaper is to be supplied by customer unless otherwise stated.
Some wall coverings may be priced higher to install; ie.untrimmed paper or use of lining paper.
Occupants must vacate work area while job is in progress.
Customer is to be available to meet with foreman on the last day of working to sign off the job and make the Final Payment.
CHANGES TO THE ORIGINAL QUOTATION / ESTIMATE
This is only a proposal and your acceptance is subject to our approval in order to make this contract binding.
If after you agree to this work, you desire any changes of additional work, please contact us as the cost of all revisions must be agreed upon in writing.
Workers are instructed not to undertake additional work without this authorization.
Starting date is to be agreed upon verbally.
Changes may require additional cost.
It is essential that the work area be available to us, free from other trades.
As a result of trade interference, TJ Painting and Decorating Services may leave the job and additional charges may be incurred.
Due to the concealed conditions of existing wall coverings, it may be impossible to estimate the labour of removal and preparation necessary to achieve properly painted or wall papered surface.
Under normal conditions wall covering can be removed properly without damage to the surface; however,sometimes the substrate has not been sealed properly or other hidden conditions may exist.
Due to these factors, added labour and material cost may become necessary. If these conditions exist, the owner will be notified before further work commences.
COST
We propose to furnish material and labour - complete and in accordance with the above specifications for the sum of all as stated above.
Individual tasks, if selected, may require additional pricing. Price is valid for thirty (30) days, unless otherwise noted.

LAST DAY OF WORKING
All outstanding Invoices are due on satisfactory completion of the work, unless otherwise stated. Payments not received on the agreed date will be charged at 3% over bank base rate based on the outstanding monies owed
